# Gemmein Engine License

Version 1.0 — effective from the date of the engine release it accompanies.

This license is between you and **Gemmein Limited**, a company registered in
England and Wales (Company No. 17339623) ("Gemmein"), and covers the Gemmein
engine artifact — the files distributed from downloads.gemmein.com and verified
by the `gemmein` command-line tool (the "Engine").

By downloading or running the Engine, you agree to these terms.

The `gemmein` npm launcher in `shim/` is separate and MIT-licensed; this
license covers only the downloaded Engine.

## 1. What you may do

Gemmein grants you a personal, non-exclusive, non-transferable licence to
download, cache, and run the Engine on machines you control, for the purpose of
developing and testing applications that work with Gemmein's services.

Once cached, the Engine works offline. You may keep using a cached copy under
these terms even if that version is later retired from distribution.

## 2. What you may not do

You may not:

- redistribute, sell, rent, sublicense, or host the Engine for anyone else;
- copy, modify, or create derivative works of the Engine, or extract any part
  of its code for use elsewhere;
- reverse-engineer, decompile, or disassemble the Engine, except to the extent
  the law expressly permits despite this restriction;
- bypass or tamper with the integrity verification the `gemmein` tool performs;
- use the Engine to build, train, or operate a product or service that competes
  with Gemmein.

## 3. Ownership

The Engine is licensed, not sold. Gemmein and its licensors retain all rights,
title, and interest in the Engine, including all intellectual property rights.
Nothing in this license transfers any ownership to you.

## 4. Versions and updates

Gemmein may release new versions of the Engine and may retire old versions from
distribution at any time. Gemmein has no obligation to maintain, support, or
update any version. Section 1's cached-copy right survives retirement.

## 5. Gemmein services

This license covers only the Engine running locally. Your use of Gemmein's
hosted services — including any application you take live — is governed
separately by the Gemmein Terms of Service at gemmein.com/terms.

## 6. Termination

This license ends automatically if you breach it. When it ends, you must stop
using the Engine and delete cached copies. Sections 3, 7, and 8 survive
termination.

## 7. No warranty

The Engine is provided **"as is"**, without warranty of any kind, express or
implied, including fitness for a particular purpose, merchantability, and
non-infringement. You use it at your own risk. Nothing in this license affects
statutory rights that cannot be excluded by law.

## 8. Limitation of liability

To the fullest extent permitted by law, Gemmein will not be liable for any
indirect, incidental, special, or consequential loss, or any loss of profits,
revenue, data, or goodwill, arising from your use of the Engine. Gemmein's
total liability under this license is limited to £100. Nothing limits
liability for death or personal injury caused by negligence, fraud, or any
other liability that cannot lawfully be limited.

## 9. General

This license is the entire agreement about the Engine. If any part is found
unenforceable, the rest stands. This license is governed by the laws of England
and Wales, and the courts of England and Wales have exclusive jurisdiction.
